These General Conditions govern the terms and conditions under which WAI SRL offers for sale the products featured on the website www.zagogz.com (hereinafter, the “Site”).

By using or accessing the Site and/or placing an order, you agree to be legally bound by these Terms.

2. USE OF THE SITE

We make every effort to ensure the accuracy of the content published on the Site, including product descriptions; however, errors or inaccuracies may occur.

We try to represent the products (including images) as accurately as possible. However, there may be differences due to monitor settings and characteristics or color rendering in print, for which we cannot be held responsible.

The contents of the Site are provided for informational purposes only and are subject to change without notice. Neither we nor any third parties guarantee the accuracy, currency, performance, completeness, or suitability of the information and materials on the Site for any particular purpose. You acknowledge that such information may contain errors, and we disclaim all liability for such inaccuracies, to the fullest extent permitted by law.

3. PRODUCT AVAILABILITY AND ORDER ACCEPTANCE

Products are offered for sale subject to availability and order acceptance by WAI SRL, which reserves the right to refuse an order even without specifying the reason. In this case, we will inform you as soon as possible and, if payment has already been made, a refund will be issued for the refused orders.

WAI SRL may issue gift or promotional codes. These codes are valid only according to the terms communicated at the time of issue. If you attempt to use a code not intended for your use or for purposes other than those intended, WAI SRL may refuse your order; in this case, any payments already made will be refunded.

After submitting your order, you will receive an email confirming your transaction/order receipt.

4. PRICES AND PAYMENT METHODS

All prices are in Euros (€) . Applicable taxes (e.g., Italian VAT , if applicable) are calculated and added during checkout. The price does not include any delivery costs, which will be indicated before confirming the order.

Payments can be made via Credit Cards, PayPal and bank transfer .

For deliveries outside of Italy, we cannot predict any additional costs (e.g., duties, taxes, or customs charges), as customs policies vary from country to country. If you purchase from abroad, any customs charges will be your responsibility, unless otherwise specified.

Prices may change at any time, but these changes will not apply to orders already shipped. Despite our best efforts, some products on the Site may be listed at incorrect prices. We generally verify prices when preparing/shipping your order:

  • if the correct price is lower than the one indicated, we will apply the lower price;

  • If the correct price is higher than the price stated, we may, at our discretion, contact you for instructions before shipping or refuse your order and notify you of this.

We are not obliged to supply the product at the incorrect (lower) price if the error is obvious and recognisable.

Full payment is usually taken at the time of ordering; we reserve the right to verify/validate the payment before accepting the order. If the order is rejected, a full refund will be issued if payment has already been received.

5. THIRD PARTY WEBSITES

The Site may contain links to third-party websites, including non-affiliated websites. We do not guarantee that products purchased from these third parties are fit for purpose or of satisfactory quality; any such guarantees are excluded by us. This exclusion does not affect your rights against the third-party seller, where applicable.

6. COMMUNICATIONS AND COMPLAINTS

A communication is considered received and duly notified:

  • immediately, if published on the Site;

  • within 48 hours of sending, if sent by email;

  • within two (2) days from the date of shipment, if sent by letter.

For the purposes of proving notification, it will be sufficient to demonstrate that:

  • in the case of a letter, it was correctly addressed, stamped and sent;

  • In case of email, it was sent to the recipient's email address.

7. ENTIRE AGREEMENT

These Terms, any applicable privacy policy for the Site, and any documents expressly referred to herein constitute the entire agreement between the parties and supersede any prior understanding, agreement, or arrangement, whether oral or written, relating to the same subject matter.

The parties acknowledge that, in entering into the contract, they have not relied on any representations or promises not expressly stated in these Conditions.

8. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

The contents of the Site are provided “ as is ” and, to the maximum extent permitted by law, without warranties of any kind, either express or implied, including (but not limited to) warranties of title, merchantability or fitness for a particular purpose.

You use the Site at your own risk. To the extent permitted by law, WAI SRL will not be liable for damages of any kind related to your use of the Site.

Sale "as is" / limitation of remedies (to the extent permitted by law): Except where otherwise provided by applicable mandatory laws, the goods are sold "as is" and WAI SRL disclaims any express or implied warranties. In any event, WAI SRL's liability for damages shall not exceed the amount paid by the buyer for the disputed item. WAI SRL shall not be liable for indirect, consequential, or punitive damages, nor for loss of profits/revenues, loss of use, damage to equipment, replacement costs ("cover"), downtime, or warranty claims, except where otherwise provided by law.

9. APPLICABLE LAW AND JURISDICTION

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Italy . Any dispute arising from them shall be subject to the exclusive jurisdiction of the Italian courts , except as provided by mandatory consumer protection provisions.

10. INDEMNIFICATION

You agree to indemnify and hold WAI SRL harmless from any claims, damages, costs and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site in violation of these Terms or applicable law.

11. DELAYS OR FAILURE TO DELIVERY

Unless otherwise agreed in writing, WAI SRL will not be liable for delays or failures to deliver due to causes beyond its sole control. Any waiver of rights or remedies relating to transactions between buyer and seller will be valid only if formally in writing and signed by an authorized representative of WAI SRL.
