These General Conditions govern the terms and conditions under which WAI SRL offers for sale the products available on the website www.zagogz.com (hereinafter, the "Site").

We invite you to read these General Conditions carefully, as they protect your interests. For comments, problems or requests related to WAI SRL and/or the products and services offered on the Site, you can contact us at the addresses indicated.

By using or accessing the Site and/or placing an order, you agree to be legally bound by these Conditions.

2. USE OF THE SITE

We do our best to ensure the accuracy of the content published on the Site, including product descriptions; however, errors or inaccuracies may occur.

We try to represent the products (including images) as faithfully as possible. However, there may be differences due to screen settings and characteristics or color rendering in print, for which we cannot be held responsible.

The contents of the Site are provided for informational purposes and may be modified without notice. Neither we nor any third parties guarantee the accuracy, timeliness, performance, completeness or suitability of the information and materials on the Site for a specific purpose. You acknowledge that such information may contain errors and we disclaim all liability for such inaccuracies, to the maximum extent permitted by law.

The Site may include links to third-party sites. These links are provided for convenience and do not imply endorsement or control of the content by us. We are not responsible for the content of linked sites.

Any material downloaded or obtained through the use of the Site is done at your sole discretion and risk; you will be solely responsible for any damage to your device or loss of data resulting from such operations.

3. PRODUCT AVAILABILITY AND ORDER ACCEPTANCE

Products are offered for sale subject to availability and prior acceptance of the order by WAI SRL, which reserves the right to refuse an order even without specifying the reason. In such a case, we will inform the user as soon as possible and, if payment has already been made, a refund will be issued for refused orders.

WAI SRL may issue gift or promotional codes. Such codes are valid only according to the terms communicated at the time of issue. If an attempt is made to use a code not intended for one's own use or for purposes other than those intended, WAI SRL may refuse the order; in such a case, any amount already paid will be refunded.

After placing your order, you will receive an email confirming the transaction/order receipt.

4. PRICES AND PAYMENT METHODS

All prices are indicated in Euro (€). Applicable taxes (e.g. Italian VAT, if due) are calculated and added during checkout. The price does not include any delivery costs, which will be indicated before order confirmation.

Payments can be made via Credit Cards, PayPal.

For deliveries outside Italy, we cannot foresee any additional costs (e.g. duties, taxes or customs charges), as customs policies vary from country to country. If you purchase from abroad, any customs charges will remain your responsibility, unless otherwise indicated.

Prices may vary at any time, but such variations will not apply to orders already shipped. Despite our efforts, it is possible that some products on the Site may be listed with an incorrect price. We usually verify prices during order preparation/shipping:

  • if the correct price is lower than the one indicated, we will apply the lower price;

  • if the correct price is higher than the one indicated, we may, at our discretion, contact you for instructions before shipping or refuse the order, notifying you.

We are not obligated to provide the product at the incorrect (lower) price if the error is obvious and recognizable.

Full payment is normally collected at the time of order; we reserve the right to verify/validate payment before accepting the order. In case of order refusal, a full refund will be issued if payment has already been received.

5. THIRD-PARTY WEBSITES

The Site may contain links to third-party websites, including non-affiliated ones. We do not guarantee that products purchased through such third parties are fit for purpose or of satisfactory quality; any warranties in this regard are excluded on our part. This exclusion does not affect the user's rights against the third-party seller, where applicable.

6. COMMUNICATIONS AND COMPLAINTS

For communications and complaints, you can contact:

A communication is considered received and duly notified:

  • immediately, if published on the Site;

  • within 48 hours of sending, if sent via email;

  • within two (2) days from the date of shipment, if sent via letter.

For proof of notification, it will be sufficient to demonstrate that:

  • in the case of a letter, it was correctly addressed, stamped and posted;

  • in the case of an email, it was sent to the recipient's email address.

7. ENTIRE AGREEMENT

These Conditions, any privacy policy of the Site and any expressly referenced document constitute the entire agreement between the parties and supersede any previous understanding, agreement or stipulation, oral or written, relating to the same subject matter.

The parties acknowledge that, in concluding the contract, they did not rely on statements or promises not expressly stated in these Conditions.

8. EXCLUSION OF WARRANTIES AND LIMITATION OF LIABILITY

The contents of the Site are provided "as is" and, to the maximum extent permitted by law, without warranties of any kind, express or implied, including (by way of example) warranties of title, merchantability or fitness for a particular purpose.

You use the Site at your sole risk. To the extent permitted by law, WAI SRL will not be liable for damages of any nature connected to the use of the Site.

"As is" sale / limitation of remedy (to the extent permitted by law): unless otherwise provided by applicable mandatory rules, goods are sold "as is" and WAI SRL disclaims express or implied warranties. In any case, WAI SRL's liability for damages will not exceed the amount paid by the buyer for the disputed good. WAI SRL will not be liable for indirect, consequential or punitive damages, nor for loss of profit/revenue, loss of use, damage to equipment, replacement costs ("cover"), downtime or warranty claims, except in cases where the law provides otherwise.

9. GOVERNING LAW AND JURISDICTION

These Conditions are governed by and interpreted according to the law of the Italian Republic. Any dispute arising from them will be referred to the exclusive jurisdiction of the Italian Courts, except as provided by mandatory consumer protection regulations.

10. INDEMNIFICATION

You agree to indemnify and hold WAI SRL harmless from any claim, damage, cost and expense (including reasonable legal fees) arising from or related to your use of the Site in violation of these Conditions or applicable law.

11. DELAYS OR NON-DELIVERY

Unless otherwise agreed in writing, WAI SRL will not be liable for delays or non-delivery due to causes not subject to its exclusive control. Any waivers of rights or remedies relating to transactions between buyer and seller will only be valid if formalized in writing and signed by an authorized representative of WAI SRL.
